EUROSTAR (U.K.) LIMITED IMAGE BANK ("the Image Bank")

TERMS AND CONDITIONS

  1. 1. By accessing and registering to use the Image Bank, the registered user ("the User") will be deemed to have read and understood these terms and conditions and agree to be bound by them.
  2. 2. Subject to clauses 9, 10 and 11 below Eurostar (U.K.) Limited ("Eurostar") grants the User a non-exclusive, non-transferable licence to use those images on the Image Bank ("the Images") permitted in accordance with the classification appropriate to the User. The licence for each of the Images will commence on the first date of download by the User.
  3. 3. Eurostar makes no warranties in respect of and shall incur no liability to the User in relation to the Images or its use of the Images.
  4. 4. The Images are only accessible to the User (or the person acting under the authority of the User if a company) by using the applicable login as registered, such login to be used each time access to the Image Bank is required.
  5. 5. Any unauthorised use of the Images, modification of the Images or illegitimate use designed to cause deliberate damage to the reputation of Eurostar is expressly prohibited. Eurostar reserves the right to take any action it deems appropriate to prevent such use and the User shall indemnify Eurostar against any and all losses of whatever nature arising out of or in connection with any use prohibited under this clause.
  6. 6. Eurostar reserves the right to terminate the User's licence and access to the Image Bank at any time.
  7. 7. Unless expressly stated otherwise, copyright and all other intellectual property rights in the Images remain the property of Eurostar and/or its licensors.
  8. 8. Eurostar reserves the right to notify the User when the Images are updated and the User should make all reasonable attempts to use such updated Images where possible.
  9. 9. In the event that the User's access to the Image Bank is terminated by Eurostar, the User's licence to access and use the Images pursuant to these terms and conditions shall cease and Eurostar will reserve the right to take the appropriate preventative action. Upon termination of the licence pursuant to these terms and conditions, the User must destroy any and all versions of the Images still in its possession.
  10. 10. Eurostar reserves the right to charge for the use of the Images. Any such charges, if applied, shall be paid within 28 days of receipt by the User of a valid invoice from Eurostar and the licence granted pursuant to these terms and conditions shall be conditional upon such payment being made.
  11. 11. Eurostar reserves the right to refuse or restrict access to the Image Bank for any reason and shall incur no liability to the User in respect of any such refusal or restriction.
